General Terms and Conditions of Use

1. Summary of the main terms and conditions of sale

These General Terms and Conditions shall govern the offer and sale of the Products (as defined herein below) on the website www.brickscape.it and on other websites which redirect to brickscape.it owned by Brickscape  S.r.l., based in Pistoia, via delle Mulina 70, enrolled in the Company Register of Pistoia under no.PT-190362, Tax Code and VAT no.01913650477,

Please read all the General Terms and Conditions carefully before placing your request, as this is only a summary of the main terms and conditions of service.

    • PEOPLE ENTITLED TO PURCHASE: only adults and consumers can be customers of the Website (any natural person acting for purposes other than business, commercial, craft or professional activity)
    • PRODUCTS OFFERED (the Products): Brickscape makes available on a platform a plurality of offers from travel agencies and tour operators (the Supplier) putting the user in a position to choose the leisure services offered by the suppliers. Brickscape disclaims all responsibility for the adequacy of the Supplier’s Service or for the consequences of using the Supplier’s Service.
    • PRODUCTS AND PRICES: products are described in the “product description” page of the Website.Prices are shown in euros and always include VAT.
  • ORDERING PROCEDURE: To place a booking order for one or more Products, you must complete the Online Request Form and send it electronically to Brickscape. By submitting an Order Form to Brickscape you declare (a) to have fully read and understood the "product description" of the Supplier’s Service and (b) to unconditionally accept and undertake  to observe the provisions of these General Terms and Conditions and (where applicable) Supplier’s terms and conditions of sale (Service Conditions). We recommend that you carefully read the cancellation policies of the relevant Supplier before making your request. YOU MUST SHOW UP AT THE TIME INDICATED FOR THE PRODUCT OF THE SERVICE OF THE PURCHASED SUPPLIER, no reimbursement is granted for failure of timely attendance.

When acting as a travel agency pursuant applicable law, Brickscape is covered by insurrence No. 194904 issued by Allianz.

2. Scope

2.1 Products are offered for sale only to (a) consumers (pursuant to Legislative Decree no. 206/2005) including any individual who is acting for purposes which are outside his or her trade, business or profession; (b) adults (pursuant to the laws of their respective Country).

BrickScape shall be entitled to object to the processing of orders from persons other than consumers, and to any other order which does not comply with these General Terms and Conditions.

2.2 BrickScape provides:

  1. Information request to request only the availability of the offers inserted according to the user’s purchase needs( date, time, pax, special requests), Mode A
  2. Booking request addressed directly to the supplier according to the user’s purchase needs (date, hour, pax, special requests), Mode B.

3. Rules common to Route A, Route B and Route

  • Product information and price

3.1   The details and the information relating to the service provider and the product are indicated in the section “ Legal Notes-condition of payment-right of cancellation”. In this section you will also see the price of the relevant Product, which shall be calculated in the currency selected by you among those available and include VAT. Please ensure that all pricing information on the Website is correct before placing an order.

3.2. No payment is required when submitting your availability request . You pay the price to the supplier on-site, unless otherwise provided by the supplier’s sales policies. We recommend that you carefully read the payment policies of the relevant Provider before making your booking. The details and the information relating to the Service Provider and the Product are indicated in the section “Legal notes- Payment conditions-cancellation fee”at the bottom of the calendar of each experience or, if any, at the bottom of the product sheet.

3.3.In accordance with the provisions of art. 7 of the Italian Legislative Decree no. 633/72, The Supplier may apply VAT on invoice both to people resident for tax purposes in Italy and to consumers who are not fiscally resident in Italy.

3.4. By placing your order you state to have fully read and understood the “product description” of the selected Supplier’s Service and Product.

4.Discharge of liability

4.1. BrickScape has no liability for Suppliers’ Services, which are provided exclusively by the relevant Supplier. To the maximum extent allowed by applicable laws, you accept to discharge BrickScape from any cost, expense, loss and/or liability in which you may incur for any breach of the Service Conditions by the Supplier of BrickScape and/or for any event in any way related to the service provided by such Supplier.

4.2. By purchasing a Product you accept and agree to the relevant Service Conditions, including any cancellation and no-show policy of the relevant Supplier, and to any additional condition of the Supplier that may apply to your reservation or during your visit.

You must attend the Supplier’s Service at the day and time indicated in your Order Form. No reimbursement is granted for failure of timely attendance. If you wish to cancel your reservation, please note that you may be charged for your cancellation in accordance with the relevant Supplier's cancellation and no-show policy. We recommend that you read the cancellation and no-show policy of the Supplier carefully prior to making your reservation.

5. Ordering procedures

5.1    To send a request for availability of one or more Products on the Site, you must select the Product and fill in the online form, indicating your name and surname and your email (you can also enter useful information such as date, time, number of participants, and/or special requests). The request consists of a "customer information" section that summarizes your personal information and a second section that allows you to provide details of your request (such as number of participants, date requested). The request also includes the main features of the ordered Product, the unit price (including VAT) and a link to the Terms of Service.

In accordance with article 7 of the Italian Legislative Decree No. 633/72, VAT will be applied in the relevant invoice to both Italian tax residents and consumers which are non-Italian tax residents.

5.2  To send your details and complete the request you must be registered on the Site (by filling in the registration form to the portal brickscape.it with your personal data or by logging in through a social network account of your possession). In case you are not registered at the time of booking, a temporary profile will be created in MY brickScape with the personal data you entered in the booking form. Then you can update and modify the data entered by the system by accessing your personal profile on My Brickscape with the password of first access "My brickscape". In both cases, by registering with the Brickscape portal, you represent and warrant that all personal information provided during the registration/order process is up-to-date, complete, accurate and truthful. You authorize Brickscape to verify the correctness of your personal data and any other information provided and you undertake to cooperate with Brickscape.

If you are not registered when filling out the form, the system automatically creates your own basic profile with the information entered in the booking form ( i.e. email, first and last names). To process your request correctly, you must give your consent to the processing of your data, using the appropriate flag in the booking request form.

By submitting an Order Form to BrickScape, you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions and the Service Conditions.

5.3   The Order Form will be filed in our database for the time required to process your order and as provided by law. You may access your Order Form on your personal page of the Website section “Profile”.

6. Payments

No payment is required when submitting your reservation request. You pay the  price to the supplier on-site, unless otherwise provided by the supplier’s sales policies. We recommend that you carefully read the payment policies of the relevant Provider before making your booking. The payment policies of each supplier are indicated in the section “Legal notes- Payment conditions-cancellation fee”

 7. Rule Applicable to Route A

Brickscape provides an information request for direct contact with the provider providing the offer. By filling in the form request information about the availability of the offer. Brickscape sends notification of the request to the direct supplier. The supplier Within 24 hours reply by email to the user regarding the request received. Any booking and subsequent payment is processed by the provider on its website.

A request is deemed to be sent to the direct provider by the Brickscape website when Brickscape receives your availability request electronically and the information indicated there is verified and deemed correct.

Confirmation from BrickScape

If the request has been processed correctly (from Brickscape to the direct provider of the offer in question), you receive an email (at the address provided) informing you that your request has been notified to the supplier

 Confirmation from the supplier

Within 24 hours the supplier will send you confirmation of your booking by email. In case of non-availability the service provider may send you an email with an alternative date option.

The Service of the Supplier is subject to the Terms of Service prepared by the Supplier (whose main conditions are made available in the confirmation email above).In the presence of this mode, the request for the availability completed on BrickScape is not intended in any case an order request or booking.   

 8. Rule Applicable to Route B

  • Confirmation of the Suppliers 

With regard to certain products, as specified in the relevant fact sheets products, Brickscape provides a direct booking service from the supplier.

If you follow this mode, the reservation/ purchase is made by the user and processed directly by the provider.

Brickscape has no liability for the failure and delayed handling of the booking / purchase procedure by the supplier.

The supplier’s service is subject to the terms of service provided by the supplier (available at any time on the Supplier’s Site and on the brickscape site under Payment Policies at the bottom of each product card.)

The request made on brickscape is an order or booking request.

9. Final dispositions 

  •  Privacy

Your data is processed by BrickScape in order to supply the Products. BrickScape communicates to the Supplier – signed on the page “product information and in the purchase order” – the personal data exclusively necessary to provide the service of the supplier (Pax number the user’s name, your email address if this is needed to carry out the Supplier’s Service, and the booking reservation you have made on BrickScape.com, and all details  related thereto). BrickScape and Suppliers will act autonomously as data controllers in connection with the personal data supplied and for the sole function of providing the relevant Services. At any time you may withdraw your consent to receive BrickScape's commercial break on Products similar to those already purchased.You could also give your consent to receive commercial research communications by the Supplier and consent BrickScape and the Supplier to carry out market research studies on your own data.

  •  Amendments

The General Terms and Conditions could be changed from time to time due to new laws and regulations or other causes. The new General Terms and Conditions could be useful as of the date of publication on BrickScape.it. Please visit this part of the Website on a regular basis in order to check the publication of the most new and updated General Terms and Conditions.

  • Governing Law and Venue

These General Terms and Conditions are governed by Italian law and in particular by Legislative Decree no. 206/2005 on distance contracts and by Legislative Decree no. 70/2003 on certain points  related to e-commerce. If you have your normal residence in a EU country different from Italy, pursuant to Article 6(2) of Regulation No. 593/2008 you could enjoy the defence of the mandatory provisions of the country of your normal residence.

  • Online Dispute Resolution

Pursuant to Passage 14 of the Regulation (EU) no. 524/2013, we inform you that you may solve fights in connection to the acquisition of the Products on the Website through the ODR online platform managed by the EU Commission and accessible at the following adress.
